Terms & Conditions

Please read these terms and conditions carefully before using our services. By using our services, you agree to these terms and conditions.

 

  1. Definitions

    1. "spbpartyhire" refers to the business entity providing party rental services to customers.

    2. "Customer/client" refers to any individual or entity who has engaged spbpartyhire to provide rental services.

  2. Rental Period

    1. The rental period for our equipment is typically for a period of 4 hours, unless otherwise agreed upon in writing.

    2. Rental charges are calculated based on the rental period specified in the booking agreement.

    3. Any equipment not returned by the end of the rental period will be charged for an additional day.

  3. Equipment Use and Safety

    1. The customer is responsible for the safe and proper use of our equipment and must ensure that all users are adequately trained and supervised.

    2. The customer must comply with all relevant laws and regulations governing the use of our equipment.

    3. The customer must not alter, modify, or repair the equipment without the prior written consent of spbpartyhire.

    4. The customer is responsible for ensuring that the equipment is returned to us in the same condition as when it was rented, with normal wear and tear excepted.

  4. Booking, Deposits & Payments

    1. ​Payment for rentals must be made in full prior to the rental period.​

    2. A deposit of 20% is required to secure your booking. 

    3. The remaining balance owing must be paid at leat 7 days prior to the event, or as agreed upon in writing.

    4. Late fees may be charged for equipment returned after the end of the rental period.

  5. Liability

    1. ​Spbpartyhire is not liable for any injury or damage caused by the use of our equipment, unless caused by our negligence or breach of contract.

    2. The customer is responsible for obtaining any necessary insurance to cover any loss, damage, or liability arising from the use of our equipment.

  6. Cancellation and Refunds

    1. Cancellations must be made at least 24 hours prior to the start of the rental period.

    2. Cancellation fees may be charged for cancellations made less than 24 hours prior to the start of the rental period.

    3. No refunds will be issued for equipment returned early.

  7. Force Majeure

    1. Spbpartyhire is not liable for any delay, failure, or interruption of service resulting from circumstances beyond our reasonable control, including but not limited to natural disasters, death, strikes, COVID-19 or government actions.

  8. Governing Law and Jurisdiction

    1. These terms and conditions shall be governed by and construed in accordance with the laws of the state of New South Wales, Australia.

    2. Any disputes arising under or in connection with these terms and conditions shall be subject to the non-exclusive jurisdiction of the courts of New South Wales.

  9. Changes to these Terms and Conditions

    1. spbpartyhire reserves the right to modify these terms and conditions at any time.

    2. The updated terms and conditions will be posted on our website and will be effective immediately upon posting.

  10. 360 Video booth

    1. The 360 photobooth is a specialized piece of equipment that requires additional care and attention during use.

    2. The customer is responsible for ensuring that all users of the 360 photobooth are adequately trained on its proper use and safety precautions.

    3. The customer acknowledges that any damage to the 360 photobooth caused by misuse or negligence may result in additional charges.

    4. The customer grants spbpartyhire the right to use any photos or videos captured by the 360 photobooth for marketing and promotional purposes, unless otherwise agreed upon in writing.

  11. Open Air Photobooth

    1. Spbpartyhire will provide an attendant to operate the photobooth and assist guests during the rental period.

    2. The client agrees to provide a suitable location for the photobooth, with adequate space and access to power outlets.

    3. The client agrees to ensure that the photobooth location is protected from adverse weather conditions, such as rain, wind, or extreme heat, to avoid damage to the equipment and ensure the safety of guests.

    4. The client agrees to ensure that guests using the photobooth do not misuse the equipment or cause damage to the backdrop, props, or any other components of the photobooth.

    5. Spbpartyhire reserves the right to terminate the rental period early if the client or their guests are deemed to be misusing the equipment or causing damage to the photobooth.

  12. Bartending

    1. Spbpartyhire may provide bartending services upon request by the customer, subject to availability.

    2. The customer is responsible for ensuring that all users of the bartending services are of legal drinking age and are responsible drinkers.

    3. The customer acknowledges that any damage or injury caused by excessive drinking or inappropriate behaviour resulting from the bartending services will be the sole responsibility of the customer.

    4. Spbpartyhire reserves the right to refuse to serve alcohol to any individual who appears to be intoxicated or under the legal drinking age.

    5. The customer is responsible for obtaining any necessary permits or licenses required to serve alcohol at the event.

  13. Damages

    1. The client agrees to be responsible for any damages caused to the photobooth or its components during the rental period.

    2. In the event of any damages, the client agrees to pay for the cost of repairs or replacement of the damaged components, as determined by spbpartyhire.

    3. If the damages are significant enough to require the photobooth to be taken out of service during the rental period or future rental period, the client agrees to pay for any lost rental income as a result of the downtime.

    4. Spbpartyhire reserves the right to charge the cost of damages from the client or to invoice the client for the cost of damages after the event.

    5. The client agrees to pay the invoice within 30 days of receipt.
